Agreement
These Terms of Service ("Terms") govern your use of services provided by PornVM ("we", "us"). By ordering or using our services you agree to these Terms and to our Acceptable Use Policy and Privacy Policy.
Eligibility
You must be at least 18 years old and legally able to enter into a contract to use our services. If you order on behalf of a business, you confirm you are authorized to bind it to these Terms.
Your Account
Provide a working email address and keep it current. Important notices, including abuse reports, are sent there and we are not responsible for messages you miss. You are responsible for all activity under your account and for keeping your credentials secure.
The Service
Our VPS services are unmanaged. You have full root access and are responsible for installing, securing, updating and backing up your server. We maintain the underlying hardware and network.
We work hard to keep everything online, but services are provided on a best-effort basis without a guaranteed uptime SLA unless agreed in writing. Keep your own backups. We are not responsible for data loss.
Billing & Payment
- Services are billed in advance on a recurring monthly basis.
- Invoices are issued 7 days before each renewal date.
- Payment is due on the renewal date. Unpaid services are suspended 24 hours after the due date.
- Services unpaid 3 days after the due date are terminated and all data is permanently deleted. Deleted data cannot be recovered.
- Enable auto-pay or renew early to avoid interruptions. We do not offer payment extensions.
- Prices may change with at least 30 days' notice. Changes apply from your next billing cycle.
Refunds
New VPS services may be cancelled for a full refund within 72 hours of being provisioned. After that, payments are non-refundable, and services remain active until the end of the paid period. Services terminated for violating our policies are not eligible for a refund.
Cancellation & Termination
You may cancel at any time; service runs until the end of the current billing period. We may suspend or terminate service for violations of these Terms or the Acceptable Use Policy as described in that policy, or with 30 days' notice for any other reason, in which case you receive a pro-rated refund.
Content Screening
PornVM Edge includes automated screening that compares media against databases of known child sexual abuse material. This screening is provided as an additional safeguard only. It relies on third-party hash databases, can only detect previously identified material, and will not catch everything.
Screening does not replace your own obligations. You remain solely responsible for all content on your services, including moderating user uploads, verifying the age and consent of everyone depicted, and complying with the law. PornVM makes no guarantee that screening will detect or block any particular content, and is not liable for any content that screening fails to detect or block, or for any content it blocks in error.
Limitation of Liability
To the maximum extent permitted by law, our services are provided "as is" without warranties of any kind. We are not liable for indirect, incidental or consequential damages, lost profits or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
Indemnification
You agree to defend and indemnify PornVM against claims, damages and costs, including reasonable legal fees, arising from your content, your use of our services, or your violation of these Terms or the law.
General
These Terms are governed by the laws of the United States and the state in which PornVM is organized, without regard to conflict-of-law rules. If any part of these Terms is found unenforceable, the rest remains in effect. We may update these Terms; material changes will be emailed to you at least 14 days before they take effect.
